Artwork & Intellectual Property Policy

BrandUp Co., LLC

By submitting any artwork, logos, text, or designs (“Artwork”) to BrandUp Co., LLC, you agree to the following:

Ownership & Authorization

You represent and warrant that you own all rights to the Artwork submitted or have obtained full permission and authorization from the rightful owner to reproduce, modify, and use the Artwork for production.

Customer Responsibility

You assume full responsibility for any claims, damages, or legal actions arising from the use of submitted Artwork, including but not limited to copyright, trademark, or intellectual property infringement.

No Liability

BrandUp Co., LLC does not verify ownership of submitted Artwork and shall not be held liable for any unauthorized use of intellectual property provided by the customer.

Indemnification

You agree to indemnify, defend, and hold harmless BrandUp Co., LLC, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to the use of submitted Artwork.

Right to Refuse Service

BrandUp Co., LLC reserves the right to refuse, cancel, or delay any order that includes Artwork deemed to be infringing, unlawful, offensive, or otherwise inappropriate at our sole discretion.

Use of Artwork

Submitted Artwork will be used solely for the purpose of fulfilling your order unless otherwise agreed in writing. BrandUp Co., LLC does not claim ownership of customer-provided Artwork.

Proof Approval

If a proof or mockup is provided, production will not begin until approval is received. Approval confirms that all details—including spelling, layout, sizing, and placement—are correct. BrandUp Co., LLC is not responsible for errors approved by the customer.

Color & Print Variations

Due to differences in screens, materials, and production methods, slight variations in color, size, and placement may occur. These are not considered defects.
